Terms of Use

1 Parties and Acceptance

These Terms of Use ("Terms") are a contract between you ("you", "user") and the operator of Mergen AI ("Mergen AI", "we", "us"):

By creating an account, or by using the Mergen AI mobile application, website, or related services (together, the "Services"), you accept these Terms. If you do not agree, do not use the Services.

2 Eligibility

• You must be at least 18 years old to use the Services. Mergen AI's content (predictions, odds-related information) is adjacent to sports-wagering content, and we restrict access to adults only.
• You may hold only one account per person.
• You may not use the Services if doing so would violate the laws of the country or region you are in.
• You represent that the information you provide when creating an account is accurate.

3 Service Description

Mergen AI provides:

• AI-generated football predictions (e.g. Over/Under goal predictions), based on statistical models and historical data.
• Suggested betting slips ("coupons"), personalized to a risk category you select during onboarding.
• Terminal, a simulated portfolio feature described in Section 5.
• Mercoin, an in-app virtual currency described in Section 9.
• A referral program described in Section 10.
• Subscription tiers (Freemium, Pro, Premium) that unlock different levels of access, described in Section 7.

The exact features available to you depend on your subscription tier and are shown in the app.

4 Not Gambling. Not Advice.

Nothing in the Services constitutes financial advice, investment advice, betting advice, or any other kind of professional advice or recommendation. You are solely responsible for any decisions you make based on information from the Services, including any decision to place a bet with a third party.

Our predictions can be wrong. Mergen AI's AI models are not guaranteed to be accurate, and past accuracy (including any accuracy statistics we publish) does not predict future results. You should not rely on any prediction, statistic, or suggestion from the Services as a sole source of truth.

If you choose to gamble, gambling carries financial risk and can be addictive. Gamble responsibly, within your means, and in accordance with the laws that apply to you. For support and guidance on safer gambling:

5 Terminal

Terminal is a simulation tool. It models a hypothetical betting bankroll using suggested stakes and slips, so you can see how a strategy might have performed.

6 Accounts and Social Login

You can create a Mergen AI account by email and password, or by signing in with your Google or Apple account. If you sign in with Google or Apple, we receive only the information that provider shares with us (typically your name and email address, or an Apple-provided private relay address if you choose to hide your email).

You are responsible for keeping your login credentials confidential and for all activity on your account. Notify us immediately if you suspect unauthorized access.

You may delete your account at any time from within the app (Settings → Delete Account). See Section 9 for what happens to Mercoin when you do.

7 Subscriptions

No free trial is currently offered. Pro and Premium are paid, auto-renewing subscriptions, billed through the Apple App Store (and, once available, Google Play).

• Current price and billing period (monthly or annual, where offered) for each tier are shown at the point of purchase in the app. Prices may change; where they do, the change takes effect following the notice process required by the App Store or Play Store.
• Auto-renewal: your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the current period ends.
• Cancellation: manage or cancel your subscription in your device's subscription settings (iOS Settings → [your name] → Subscriptions, or the Google Play Subscription Center) — not through Mergen AI directly, since Apple/Google are the merchant of record.
• Upgrades and downgrades: upgrading to a higher tier takes effect immediately; downgrading takes effect at the end of your current billing period.
• Cancelling does not entitle you to a refund for the current billing period, except as Apple's or Google's refund policies, or applicable law, may separately provide.

8 Payments, Refunds, and Your Right to Cancel

Apple (and, once available, Google) is the merchant of record for all purchases — subscriptions, individual match/slip purchases, and Mercoin packs. Mergen AI does not process your payment or store your card details.

• Refunds for App Store or Play Store purchases are handled by Apple or Google under their own refund policies. Mergen AI cannot issue refunds directly for purchases made through the app stores.
• Turkish users: under Turkish consumer law, you generally have 14 days to cancel a distance contract without giving a reason. This right does not apply to (a) Mercoin purchases, because they are digital content delivered to you instantly, and (b) subscriptions once you've given your approval for the service to start before the 14 days are up — which happens automatically when you complete a purchase in the app. By completing a purchase, you acknowledge and agree that your cancellation right ends once the Mercoin is credited or the subscription begins.
• UK/EU users: similarly, your right to cancel a digital-content or digital-service purchase within the standard cooling-off period does not apply once you've expressly asked for delivery/performance to begin immediately and acknowledged that doing so ends your cancellation right — which, again, happens automatically when you complete a purchase in the app.
• None of the above affects any right you have under applicable law that cannot be waived by agreement (for example, your rights if a purchase was faulty, unauthorized, or materially not as described).

9 Mercoin

Mercoin is Mergen AI's in-app virtual currency, used to unlock individual match predictions and betting slips.

• Mercoin is a limited, personal, non-transferable, non-sublicensable, revocable licence to use a feature within the Services — it is not your property, and it is not money, e-money, or any kind of financial instrument.
• Mercoin has no cash value. It cannot be exchanged, transferred, gifted, sold, or redeemed for money or anything of monetary value, and it cannot be used outside Mergen AI.
• Mercoin you purchase does not expire.
• You can earn Mercoin two ways: buying a Mercoin pack (25, 50, or 100 Mercoin — current prices shown at purchase), or earning it through the referral program (Section 10).
• All Mercoin purchases are final and non-refundable, except as required by law or as Apple's/Google's refund policies separately provide (see Section 8).
• If you delete your account, any remaining Mercoin — whether purchased or earned — is permanently lost. This applies however the balance was built up, and happens as a consequence of deleting your account entirely, not as a separate penalty.
• If Mergen AI ever discontinues the Services, any remaining Mercoin balance will also be lost; we are not obligated to provide a refund or conversion for unused Mercoin in that case, except where required by law.

10 Referral Program

You can refer friends to Mergen AI using your personal referral code.

• If the person you refer completes registration using your code, they receive 30 Mercoin, and:
  • If you are a Freemium user, you receive 30 Mercoin too (maximum 5 rewarded referrals per Freemium account).
  • If you are a Pro or Premium subscriber, you receive a 7-day extension to your current subscription instead (maximum 3 rewarded referrals per Pro/Premium account).
• You may not refer yourself, and you may not create multiple, fictitious, or fake accounts to earn referral rewards. We may detect this using account, device, and payment signals.
• No spam. Don't distribute your referral link through bulk/unsolicited messages, or buy paid advertising that targets your referral link directly.
• We may withhold, deny, reverse, or cancel a referral reward, and may suspend or terminate an account, if we reasonably believe referral activity is fraudulent or abusive.
• We may change the referral program's rewards, limits, or terms from time to time. We'll give you notice before a material change takes effect — we won't apply changes retroactively to referrals you've already completed.

11 Acceptable Use

You agree not to:

• Scrape, systematically extract, or bulk-download content from the Services.
• Resell, redistribute, or commercially repackage Mergen AI's predictions, statistics, or betting slips (for example, as a "tipster" service).
• Use bots, scripts, or other automated means to interact with the Services, except where we explicitly provide an API for that purpose.
• Reverse-engineer, decompile, or attempt to extract the underlying models or source code behind the Services.
• Use the Services for any unlawful purpose, or in a way that could disable, overburden, or impair them.

12 Intellectual Property

Mergen AI and its licensors own all rights, title, and interest in the Services, including our prediction models, software, content, trademarks, and designs. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Services for your own personal, non-commercial use, subject to these Terms.

If you send us feedback or suggestions about the Services, you agree we can use them without any obligation to you.

13 Third-Party Services

The Services rely on third-party providers, including Apple (App Store, Sign in with Apple), Google (Play Store, once available; Google Sign-In), RevenueCat (subscription and purchase infrastructure), and data/AI providers used to build our prediction models. Your use of these providers' own services (for example, signing in with your Apple or Google account) is also subject to their own terms.

14 Disclaimers and Limitation of Liability

The Services are provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We do not guarantee the Services will be uninterrupted, error-free, or that any prediction or statistic will be accurate.

To the fullest extent permitted by law, Mergen AI is not liable for any indirect, incidental, or consequential damages arising from your use of the Services, including any losses connected to a decision you made based on our predictions or statistics.

15 Suspension and Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent or abusive behavior (including referral abuse, see Section 10), or if required by law. Where reasonably possible, we'll give you notice first.

You may stop using the Services, or delete your account, at any time (Section 6). Terminating your account ends your subscription access and forfeits any remaining Mercoin (Section 9); it does not entitle you to a refund for any period already paid for, except as Section 8 separately provides.

16 Changes to These Terms

We may update these Terms from time to time. If we make a material change, we'll give you notice (for example, an in-app notice requiring you to re-accept before continuing) before the change takes effect. Continuing to use the Services after a material change takes effect means you accept the updated Terms.

17 Governing Law and Disputes

• If you are reading the Turkish-language version of these Terms, they are governed by the laws of the Republic of Türkiye. If you are a consumer, disputes may be brought before the Tüketici Hakem Heyeti (Consumer Arbitration Board) or Tüketici Mahkemesi (Consumer Court) in accordance with Turkish consumer law.
• If you are reading the English-language version of these Terms, they are governed by the laws of England and Wales.

18 Apple-Specific Terms

If you downloaded the app from the Apple App Store, the following also apply:

• This agreement is between you and Mergen AI only, not Apple. Apple has no obligation to furnish any maintenance or support for the app.
• Mergen AI, not Apple, is responsible for the app and its content, and for addressing any claims relating to it (for example, product liability claims, or claims that the app fails to conform to any legal or regulatory requirement).
• Apple is a third-party beneficiary of these Terms, and may enforce them against you.
• You represent that you are not located in a country subject to a U.S. government embargo, and are not on any U.S. government list of prohibited or restricted parties.

1 Taraflar ve Kabul

Bu Kullanım Koşulları ("Koşullar"), siz ("kullanıcı", "siz") ile Mergen AI'nın işleteni arasında bir sözleşmedir:

Hesap oluşturarak veya Mergen AI mobil uygulamasını, web sitesini veya ilgili hizmetlerini ("Hizmetler") kullanarak bu Koşulları kabul etmiş olursunuz. Kabul etmiyorsanız, Hizmetleri kullanmayınız.

2 Uygunluk

• Hizmetleri kullanmak için en az 18 yaşında olmalısınız. Mergen AI'nın içerikleri (tahminler, oran bilgileri) spor bahisleriyle ilişkili olduğundan, erişimi yalnızca yetişkinlerle sınırlıyoruz.
• Kişi başına yalnızca bir hesap açabilirsiniz.
• Bulunduğunuz ülke veya bölgenin kanunlarını ihlal edecek şekilde Hizmetleri kullanamazsınız.
• Hesap oluştururken verdiğiniz bilgilerin doğru olduğunu beyan edersiniz.

3 Hizmet Tanımı

Mergen AI şunları sunar:

• Yapay zeka destekli futbol tahminleri (örn. Alt/Üst 2.5 gol tahminleri), istatistiksel modellere ve geçmiş verilere dayalı olarak.
• Kayıt sırasında seçtiğiniz risk kategorisine göre kişiselleştirilmiş önerilen bahis kuponları.
• Madde 5'te tanımlanan Terminal simülasyon özelliği.
• Madde 9'da tanımlanan Mercoin uygulama içi sanal para birimi.
• Madde 10'da tanımlanan referans programı.
• Erişim seviyenizi belirleyen abonelik planları (Freemium, Pro, Premium), Madde 7'de tanımlanmıştır.

Size sunulan özellikler, abonelik planınıza göre değişir ve uygulama içinde gösterilir.

4 Bahis Değildir. Tavsiye Değildir.

Hizmetlerdeki hiçbir içerik finansal tavsiye, yatırım tavsiyesi, bahis tavsiyesi veya başka herhangi bir profesyonel tavsiye veya öneri niteliği taşımaz. Hizmetlerden edindiğiniz bilgilere dayanarak aldığınız kararlardan (üçüncü bir tarafta bahis oynama kararı dahil) yalnızca siz sorumlusunuz.

Tahminlerimiz yanlış olabilir. Mergen AI'nın yapay zeka modelleri kesin doğruluk garantisi vermez; yayınladığımız geçmiş doğruluk istatistikleri dahil, geçmiş performans gelecekteki sonuçları garanti etmez. Hiçbir tahmin, istatistik veya öneriyi tek doğru kaynak olarak kabul etmemelisiniz.

Bahis oynamayı tercih ederseniz, bahis finansal risk taşır ve bağımlılık yapabilir. Sorumlu bir şekilde, imkanlarınız dahilinde ve size uygulanan kanunlara uygun şekilde hareket edin. Destek ve rehberlik için: Sorumlu Oyun Hakkında sayfamıza bakabilir, veya Yeşilay Danışma Hattı'nı (115, ücretsiz, 7/24) arayabilirsiniz.

5 Terminal

Terminal, bir simülasyon aracıdır. Önerilen bahis miktarları ve kuponları kullanarak varsayımsal bir bahis bütçesini modeller; böylece bir stratejinin geçmişte nasıl performans gösterebileceğini görebilirsiniz.

6 Hesaplar ve Sosyal Giriş

Mergen AI hesabınızı e-posta ve şifre ile, veya Google ya da Apple hesabınızla giriş yaparak oluşturabilirsiniz. Google veya Apple ile giriş yaparsanız, yalnızca bu sağlayıcıların bizimle paylaştığı bilgileri (genellikle adınız ve e-posta adresiniz, veya e-postanızı gizlemeyi seçtiyseniz Apple'ın sağladığı gizli bir yönlendirme adresi) alırız.

Giriş bilgilerinizin gizliliğini korumaktan ve hesabınızdaki tüm etkinlikten siz sorumlusunuz. Yetkisiz erişim şüphesi durumunda bizi derhal bilgilendirin.

Hesabınızı istediğiniz zaman uygulama içinden silebilirsiniz (Ayarlar → Hesabı Sil). Hesap silindiğinde Mercoin'inize ne olacağı için Madde 9'a bakınız.

7 Abonelikler

Şu anda ücretsiz deneme sunulmamaktadır. Pro ve Premium, Apple App Store üzerinden (ve kullanıma sunulduğunda Google Play üzerinden) faturalandırılan, otomatik yenilenen ücretli aboneliklerdir.

• Güncel fiyat ve faturalandırma dönemi (aylık veya yıllık, sunulduğu yerlerde), her plan için uygulama içinde satın alma anında, her faturalandırma dönemi bazında gösterilir. Fiyatlar değişebilir; değişiklik, App Store veya Play Store'un gerektirdiği bildirim süreci sonrasında yürürlüğe girer.
• Otomatik yenileme: mevcut dönem bitmeden en az 24 saat önce iptal etmediğiniz sürece aboneliğiniz her faturalandırma döneminin sonunda otomatik olarak yenilenir.
• İptal: aboneliğinizi, Mergen AI üzerinden değil, cihazınızın abonelik ayarlarından yönetin veya iptal edin (iOS Ayarlar → [adınız] → Abonelikler, veya Google Play Abonelik Merkezi) — çünkü satıcı kaydı Apple/Google'dadır.
• Yükseltme ve düşürme: üst plana yükseltme anında etkili olur; alt plana düşürme mevcut faturalandırma döneminin sonunda etkili olur.
• İptal etmek, Madde 8'de ayrıca belirtilenler dışında, mevcut faturalandırma dönemi için size iade hakkı vermez.

8 Ödemeler, İadeler ve Cayma Hakkınız

Tüm satın alımlar için (abonelikler, tekil maç/kupon satın alımları ve Mercoin paketleri) satıcı kaydı Apple'dadır (ve kullanıma sunulduğunda Google'dadır). Mergen AI ödemenizi işlemez veya kart bilgilerinizi saklamaz.

• İadeler, Apple veya Google'ın kendi iade politikaları kapsamında, App Store veya Play Store üzerinden yönetilir. Mergen AI, uygulama mağazaları üzerinden yapılan satın alımlar için doğrudan iade işlemi gerçekleştiremez.
• Cayma hakkınız: 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği uyarınca, mesafeli sözleşmelerden genel olarak 14 gün içinde, gerekçe göstermeksizin cayma hakkınız bulunur. Ancak bu hak:
  • Mercoin satın alımları için uygulanmaz, çünkü Mercoin elektronik ortamda anında ifa edilen, size anında teslim edilen gayrimaddi bir hizmettir (Mesafeli Sözleşmeler Yönetmeliği m. 15/1-ğ).
  • Abonelikler için, cayma hakkı süresi (14 gün) dolmadan önce, onayınızla hizmetin ifasına başlandığı andan itibaren uygulanmaz (m. 15/1-h). Uygulama içinde satın alma işlemini tamamladığınızda, hizmetin derhal başlamasını onayladığınızı ve bu onayla cayma hakkınızın sona erdiğini kabul etmiş olursunuz.
  • Size cayma hakkınız hakkında gerektiği gibi bilgi verilmemişse, 14 günlük süre işlemez ve hakkınız en fazla bir yıl daha devam eder (m. 10).
• Abonelik iptali, 6502 sayılı Kanun'un 52. maddesi ve Abonelik Sözleşmeleri Yönetmeliği uyarınca, gerekçe göstermeksizin ve cezai şart ödemeksizin yapılabilir; talebiniz 7 gün içinde işleme alınır. İptal işlemi, abone olmaktan daha zor olmayacak şekilde sunulur.
• Yukarıdakilerin hiçbiri, anlaşmayla kaldırılamayacak kanuni haklarınızı etkilemez.
• Uyuşmazlık durumunda, Tüketici Hakem Heyeti'ne veya Tüketici Mahkemesi'ne başvurabilirsiniz (bkz. Madde 17).

9 Mercoin

Mercoin, tekil maç tahminlerini ve bahis kuponlarını açmak için kullanılan, Mergen AI'ya özgü uygulama içi sanal para birimidir.

• Mercoin, Hizmetler içindeki bir özelliği kullanmanız için size tanınan sınırlı, kişisel, devredilemez, alt lisanslanamaz ve geri alınabilir bir kullanım hakkıdır — mülkiyetiniz değildir ve para, e-para veya herhangi bir finansal araç niteliği taşımaz.
• Mercoin'in nakit değeri yoktur. Paraya veya herhangi bir parasal değere çevrilemez, devredilemez, hediye edilemez, satılamaz veya başka bir yerde kullanılamaz. Bu sınırlama, 6493 sayılı Kanun kapsamındaki ödeme kuruluşu lisansı gerekliliklerinin dışında kalmasını sağlar (m. 12/2-h).
• Satın aldığınız Mercoin süresi dolmaz.
• Mercoin'i iki şekilde edinebilirsiniz: bir Mercoin paketi satın alarak (25, 50 veya 100 Mercoin — güncel fiyatlar satın alma anında gösterilir) veya referans programı aracılığıyla kazanarak (Madde 10).
• Tüm Mercoin satın alımları, kanunen gerekli olduğu veya Apple/Google'ın iade politikalarının ayrıca öngördüğü haller dışında, kesindir ve iade edilemez.
• Hesabınızı silerseniz, kalan Mercoin bakiyeniz — satın alınmış veya kazanılmış fark etmeksizin — kalıcı olarak kaybedilir.
• Mergen AI, Hizmetleri sonlandırırsa, kalan Mercoin bakiyeniz de kaybedilir; kanunen gerekli olmadıkça iade yükümlülüğümüz yoktur.

10 Referans Programı

Kişisel referans kodunuzu kullanarak arkadaşlarınızı Mergen AI'ya davet edebilirsiniz.

• Davet ettiğiniz kişi kodunuzla kaydını tamamlarsa, kendisi 30 Mercoin kazanır ve:
  • Freemium kullanıcısıysanız, siz de 30 Mercoin kazanırsınız (hesap başına en fazla 5 ödüllü referans).
  • Pro veya Premium aboneyseniz, bunun yerine aboneliğinize 7 günlük bir uzatma eklenir (hesap başına en fazla 3 ödüllü referans).
• Kendinizi referans olarak gösteremezsiniz ve sahte hesap oluşturamazsınız. Bunu hesap, cihaz ve ödeme sinyalleriyle tespit edebiliriz.
• Spam yasaktır. Bu ayrıca 6563 sayılı Kanun'un 6. maddesine de aykırı olabilir.
• Kötüye kullanım şüphesinde bir ödülü alıkoyabilir, iptal edebilir, hesabı askıya alabilir veya sonlandırabiliriz.
• Program koşullarını değiştirebiliriz; önemli değişikliklerden önce sizi bilgilendiririz ve zaten tamamladığınız referanslara geriye dönük uygulamayız.

11 Kabul Edilebilir Kullanım

• Hizmetlerden içerik kazımak (scraping) veya toplu indirmek yasaktır.
• Tahminlerimizi, istatistiklerimizi veya kuponlarımızı yeniden satmak/dağıtmak yasaktır.
• Açık bir API sunmadığımız sürece bot/betik kullanmak yasaktır.
• Modellerimizi veya kaynak kodumuzu tersine mühendislikle çözmeye çalışmak yasaktır.
• Hizmetleri kanuna aykırı amaçla kullanmak yasaktır.

12 Fikri Mülkiyet

Mergen AI ve lisans verenleri, tahmin modelleri, yazılım, içerik, markalar ve tasarımlar dahil Hizmetler üzerindeki tüm hak, unvan ve menfaatlere sahiptir. Size, kişisel ve ticari olmayan kullanımınız için sınırlı, münhasır olmayan, devredilemez bir lisans veriyoruz.

13 Üçüncü Taraf Hizmetleri

Hizmetler; Apple, Google, RevenueCat ve tahmin modellerimizi oluşturmak için kullandığımız veri sağlayıcıları dahil üçüncü taraf sağlayıcılara dayanır.

14 Sorumluluk Reddi ve Sınırlaması

Hizmetler, kanunun izin verdiği azami ölçüde, herhangi bir garanti vermeksizin "olduğu gibi" sunulur.

15 Askıya Alma ve Fesih

Bu Koşulları ihlal etmeniz halinde hesabınızı askıya alabilir veya sonlandırabiliriz. Hesabınızı istediğiniz zaman silebilirsiniz (Madde 6); bu, abonelik erişiminizi sona erdirir ve kalan Mercoin'inizin kaybedilmesine yol açar (Madde 9).

16 Koşullarda Değişiklik

Önemli bir değişiklik yürürlüğe girmeden önce sizi bilgilendiririz. Değişiklik sonrası kullanmaya devam etmeniz, kabul ettiğiniz anlamına gelir.

17 Uygulanacak Hukuk ve Uyuşmazlıklar

Bu Koşullar Türkiye Cumhuriyeti kanunlarına tabidir. Tüketici sıfatına sahipseniz, 6502 sayılı Kanun uyarınca Tüketici Hakem Heyeti'ne veya Tüketici Mahkemesi'ne başvurabilirsiniz. Yerleşim yeriniz Türkiye dışındaysa, bu madde yerleşim yerinizin asgari koruma haklarınızı ortadan kaldırmaz.

18 Apple'a Özgü Hükümler

• Bu sözleşme yalnızca siz ve Mergen AI arasındadır, Apple taraf değildir.
• Uygulamadan Apple değil, Mergen AI sorumludur.
• Apple, bu Koşulların üçüncü taraf lehtarıdır.
• ABD hükümetinin ambargo uyguladığı bir ülkede bulunmadığınızı beyan edersiniz.

20 Satın Alma Öncesi Bilgilendirme

(Mesafeli Sözleşmeler Yönetmeliği m. 5 uyarınca — bu bilgiler, satın alma işlemini onaylamanızdan hemen önce uygulama içinde de ayrıca gösterilir.)

Satın alma işlemini tamamlayarak, bu bilgileri aldığınızı ve anladığınızı onaylamış olursunuz.
